Dr. Todd talks about the medical liability of doctors in the United States. The price of malpractice insurance is absurdly high, and it is raising medical costs for patients. Doctors engage in many risky procedures, Todd explains, and it is their job to minimize errors. If doctors fail to meet the standards established for their community, the State Board of Medical Examiners removes them or restricts their privileges. The problem, he argues, lies with the Trial Lawyers' Association, whose members benefit from contingency fees. Lay juries, unfamiliar with medical practice, often respond to emotion rather than fact. The solution proposed by the AMA is the creation of a "re-insurance" company. Todd hopes that a long-range program might eventually resolve malpractice claims through arbitration.
